Emergency’ of the Civil Social organizations, due to the Navy’s move of the construction resumption on Dec. 27

The civil social organizations will have the press interview to demand the stop of construction on Dec. 27.

‘The Pan-Island Committee for Prevention of the Military Base and for Realization of Island of Peace’, ‘Special Committee for the Island of Peace, Catholic Jeju District’, ‘Christian’s Council for Peace,’ in the Jeju Island will have the press interview nearby the naval base construction site, Gangjeong village at 9am, Dec. 27, 2010.

The organizations in ‘tent sit-in’ said, “ The navy is starting its active step for the naval construction following the result of the lawsuit on the annulment on the cancellation of the absolute preservation area’ on last Dec. 15,” and “ It is known that the navy is planning the large size entry of the materials to construct its site office on Dec. 27,’ through its press release on Dec. 26.
‘However those civil organizations “ emphasized that “Currently, the appeal against the Dec. 15 court decision is being moored,” and “While the conflicts among the Gangjeong villagers are being intensified due to the naval base issue and the government’s support policy reflected of the villagers’ opinion is uncertain, the navy’s move to resume the construction should be obviously stopped.”

韓国・済州島における海軍基地建設に反対します

We oppose the construction plan of a navel base on Jeju Island, Republic of Korea.

우리는 남한 제주도 해군 기지 건설 계획에 반대합니다

韓国政府は現在、済州島における海軍基地建設のための工事着工を、住民の反対の声を無視して強行しつつある。北東アジアの平和を求める私たち日本の市民は、工事着工の中止と基地建設計画の全面撤回を要求する。

The government of ROK is about to force through the startup of the construction of a naval base on Jeju Island despite the opposition by local people. We, those who seek peace in northeastern Asia, demand the cancellation of the startup of the construction work and the thorough withdrawal of the naval base plan.

남한 정부는 지역민의 반대에도 불구, 제주도 해군 기지 건설의 개시를 강행하려 합니다. 우리 동북아의 평화를 구하는 이들은 건설 작업 개시의 취소와 해군기지 계획의 완전한 철회를 요구합니다.

基地建設は、ユネスコの世界自然遺産にも登録された珊瑚礁に回復不能な打撃を与えると同時に、住民の漁業と生活をも破壊することになる。

Constructing the planned naval base would surely deal an irretrievable blow to the coral [habitat] in the sea around the island, which is registered among the World Natural Heritages by the UNESCO, as well as destroy the life of locals and their fishery.

계획된 해군 기지를 건설하는 것은 섬 주위의 유네스코에 위해 세계 자연 유산의 하나로 지정된 산호 군락에 돌이킬 수 없는 치명타를 가져올 것이며 지역민들과 그들의 생업을 파괴시킬 것입니다.

新たな海軍基地は、韓国のみならず日米をも含む「ミサイル防衛」対応イージス艦などの配備・寄港拠点となることは必至である。それは、中国に対する軍事的包囲網の強化であり、緊張を拡大することは明らかだ。済州島は軍事攻撃の対象ともなり、住民の生命はむしろ脅かされるだろう。

It is inevitable that the planned new military base would become a hub for deploying ‘Missile Defense’-system-equipped Aegis destroyers and for port calls by such wa[r] ships, being used not only by South Korea but also by the US and possibly by Japan. Such a naval base plan is for strengthening the military encirclement against China. So if constructed, that would obviously amplify tension in this area, through which process Jeju Island could become a target of military attack, with local people’s life put in danger rather than under protection.

계획된 새로운 군사 기지가 남한 뿐만 아니라 미국과 아마도 일본에 의해 ‘미사일 방어’ 시스템으로 장착된 이지스 구축함들의 배치와 그러한 전함들에 의한 항구 기항지를 위한 허브가 될 것은 피할 수 없습니다. 그러한 해군 기지 계획은 중국에 대항, 군사적 봉쇄를 강화하기 위한 것입니다. 그러므로 건설되면 지역민의 삶이 보호를 받기 보단 위험에 처하게 되며 군사 공격의 대상이 되는 과정을 통해 이 지역의 긴장을 분명히 증대시킬 것입니다.

北東アジアでは、現在、軍事的緊張が高まっている。関係国は、本来なすべき軍事演習中止と緊張緩和ではなく、武力による威嚇と軍備増強の道を進んでいる。それは、軍産複合体に格好の市場を提供することにもなる。

Currently in Northeast Asia, military tension is rising high. The countries concerned are on the path to military intimidation against each other and military buildup, instead of cancelling military drills on their parts and easing tensions, which should be rightfully dealt with by those countries. This situation is feeding military industrial complex with their desirable markets there.

현재 동북아에 군사적 긴장이 높아져 가고 있습니다. 관련된 국가들은 그들의 군사 연습들을 취소하고 긴장을 완화하기 보단 서로 군사적 위협과 군사 증강의 길위에 있는데 그러한 상황은 그 국가들에 의해 옳게 처리되어야 합니다. 이 상황은 그것을 탐하는 시장들과 함께 군산 복합체를 살찌게 합니다.

北東アジアに残る冷戦構造を終わらせ、持続可能な平和を確立しなければならない。そのために、軍事演習禁止ゾーンの設置や平和協定の締結、地域的軍縮措置こそが求められている。さらに、すべての外国軍基地の縮小と撤去が必要だ。

We should end this residue of the Cold War remaining in North East Asia and set in place sustainable peace. For that purpose, it is the installation of military-exercises free zones, signing of peace treaties, and regional disarmament measures that is needed. Additionally, it is necessary to reduce and then remove all the military bases of foreign forces in this region.

우리는 동북아에 잔존하는 냉전의 잔재들을 끝내고 지속될 수 있는 평화를 이룩해야 합니다. 그러한 목적들을 위해 필요한 것들은 군사 연습이 없는 지대들, 평화 조약에 서명하는 것들, 그리고 지역적 비무장들입니다. 추가로 이 지역 외국 군대들의 모든 군사 기지들을 축소하고 제거하는 것이 필요합니다.

沖縄・辺野古にも、韓国・済州島にも軍事基地はいらない。北東アジアに新たな軍事基地など必要ない。不信の海を信頼の海へ、対立の海を平和の海へと変えなければならない。

No need of military bases on Jeju Island, South Korea, as well as in Henoko, Okinawa. No need of a new military base in North East Asia. We must change the sea of distrust into that of trust, the sea of confrontation into that of peace.

오키나와 헤노코와 마찬가지로 남한 제주도에 군사 기지들이 세워질 필요가 없습니다. 동북아에 세로운 군사 기지가 세워질 필요가 없습니다. 우리는 불신의 바다를 신뢰의 바다로, 대결의 바다를 평화의 바다로 변화시켜야 합니다.

私たちは、基地建設に反対する済州島住民に心から連帯のエールを贈る。そして、韓国政府に対して、済州島における軍事基地建設計画を全面撤回するよう強く要求する。

We send our hearty cheers in solidarity to residents on Jeju Island who are opposed to the planned base construction, and demand that the administration of Republic of Korea fully withdraw its construction plan of a naval base on Jeju Island.

Yesterday, on Dec. 25, members of the Jeju Residents’ Self-Government Solidarity, belonging to the Pan-Island Committee for Prevention of Jeju Military Base and for Realization of Island of Peace came and took tent sit-ins in the Gangjeong village, amidst some snowflakes. In the Joongduk coast- the planned naval base area- snowflakes fell onto the beautiful coast rocks and sea, as well, displaying a mysterious view as the sea horizon became clouded. It was a terrible feeling to think that the most beautiful rocks and sea in the Jeju Island might be covered with concrete if the naval base construction is enforced. At 3pm, there was a peace mass, called, ‘the Christmas missal to save life and peace of the Jeju Island,’ lead by Fr. Kang Woo-Il, Chairman of the Catholic Bishops’ Conference of Korea & the bishop of the Catholic Jeju district, along with many fathers and nuns in the Jeju island. The event was hosted by the Special Committee for the Island of Peace, Catholic Jeju district. About 400~500 followers and Gangjeong villagers gathered and represented their will to save the Jeju island of Peace from the naval base construction. Here are some Jeju media links.

12월 25일 범대위 소속 주민 자치 연대에서 오셨습니다. 어제는 강정에도 약간의 눈이 펄펄 내렸으며 추운 가운데도 주민 자치 연대 회원들께서 천막 농성을 하셨읍니다. 중덕에는 약간의 한얀 눈송이들이 해안의 아름다운 바위들과 바다에 내리며 운무가 수평선 위로 피어오르는 등 신비로운 장관을 연출하였읍니다. 제주도에서 가장 아름다운 바위와 바다가 해군 기지로 콘크리트로 뒤덮일지 모른다니 정말로 끔찍하고 슬펐읍니다.3시에 그곳에서 천주교 제주교구 평화의섬 특별위원회 주최로 한국 가톨릭 주교회의 의장인 강우일 제주교구 주교님과 여러 신부님들께서 '제주 생명.평화를 지키기 위한 성탄절 미사' 를 집전하신 가운데 수 많은 신도들과 강정 주민분들이 모여 제주 해군 기지 반대와 평화의 섬을 지키기 위한 도민들의 뜻을 대변하였읍니다.미사의 집전 내용을 제주 언론을 빌려 알립니다. 기사의 링크에서 많은 사진들을 참조하시길.

No navel base! This land is sacred!
The tent of a Prof. Yang who has kept vigil in this cold coast for more than a year and six months to save the coast against the naval base construction.
Prof. Yang has written no naval base slogans in the many corners of the paths from the Gangjeong stream to the Joongduk coast.

12월 24일. 제주 26년만의 화이트 크리스마스라 하였습니다. 제주시에서는 눈이 펄펄 날려도 한라산은 남쪽 강정 마을이 속해 있는 서귀포 시에서는 어제 만큼은 눈을 막아 주었읍니다. 그러나 바람이 심하게 부는 무척 쌀쌀한 날이었고 이 추위는 오늘까지 계속된다 합니다.

전날 천막에서 주무신 실천 연대 제주 지부에서 오신 회원과 청년 우리에서 오신 학생 한 분이 이른 새벽 5시 30분부터 10시까지 씩씩하게 피켓팅을 하셨습니다. 피켓을 사진에서 보듯 만들어 오셨는데 심한 바람은 뒷면의 보드를 꺾어지게 까지 했습니다.(첨부 사진 참조)

10시 이후 제주 참여 환경 연대에서 오신 분들이 천막 농성의 교대를 이어갔읍니다. 어제 그 단체의 대표이신 윤용택 교수님께 오셔 여성 농민회 회원들에게 점심을 고맙게도 사주신 바 있습니다.

어제도 올레꾼들, 지나가는 운전수들의 성원이 이어졌는데 가스통들을 트럭으로 싣고 가셨던 한분께서 이 추위에 화이팅하라며 따끈한 베지밀 2 병을 갖다 주시기도 했읍니다.

어제 강정 마을회는 약 12 분이 참여, 12월 15일 절대 보전 지역 해제 취소 관련 재판의 제주 지방 법원 판결에 항소했으며 제주시지방 법원 앞에서 아침 10시30분에 12월 22일 강정 마을 총회 결과를 알리고 12월 15일 법원 판결에 항의하는 기자 회견을 가졌읍니다. (성명서 및 기사 별첨 참조, 기사에서 사진들과 제주 소리에서 비디오 참조 )

아래는 4 페이지되는 강정 마을회 성명서의 발제입니다. 좀 길지만 부분들을 인용합니다:

‘우근민 도정은 해군기지사업을 위해 김태환 전도지사가 일방적으로 저지른 절대보전지역지정해제처분에 대하여는 이미 엎질러진 물이라고 하며 직권취소를 회피하고 있고, 토지수용이 끝나기도 전에 해당지역의 농로를 주민 동의도 구하지 않고 해군에게 매각처분한 것에 대해서도 침묵하고 있다.’

‘강정주민들은 설촌 이후 사백여년 동안 강정 바닷가에서 나는 해산물을 식량과 반찬으로 먹으면서 살아왔고, 이런 천혜의 환경을 보호하기 위해 도내에서 가장 먼저 고운환경감시단을 조직하여 지상과 수상 수중환경을 보전하는데 최선을 다한 결과 제주도에서도 가장 깨끗하고 서식 동식물군이 가장 다양한 해역을 지켜낼 수 있었다. 하여 강정마을은 2006년에 환경부지정 자연생태우수마을로 지정된 바 있다.’

‘강정마을 해안 지역은 경관미가 매우 높다는 이유로 절대보전지역으로 지정받은 경관보전지구 1등급지역이다. 따라서 그 지역에 대하여 절대보전지역 지정을 해제하고자 한다면 현장조사를 해서 환경여건이 변화되어 이제는 1등급지역이 아니라는 판정을 한 다음 이를 해제해야 한다. 그러나 현장조사보고서에 의하면 “절대보전지역 지정 당시와 환경여건이 변화되지 않았다”고 기재되어 있다. 또한 멸종위기 야생동물인 붉은발 말똥게가 그 지역에 서식하는 사실이 발견되어 생태계보전지구 1등급지역에도 해당되게 되었다. 특별법과 도조례에 의하면 절대보전지역 지정을 해제할 수 없는 곳이다. 그럼에도 김태환 전 제주도정은 국책사업이라는 이유로 절대보전지역 지정 해제처분을 하여 특별법과 도조례를 정면으로 위반하였다.’

‘강정주민들은 해군기지사업 예정부지에 거주하는 직접적인 이해당사자이다. 그런데도 제주지방법원에서 강정주민들에게 원고적격이 없다는 판결을 내린 것은 강정주민이 대한민국 국민이 아닌 불법체류자의 신분이라는 판결을 내린 것이나 다름없다. 만약 강정주민들이 소송조차 제기할 자격조차 없다면, 과연 그 누가 이런 불법적인 공권력 행사에 대해 문제를 제기할 수 있단 말인가.’

‘또한 제주도의회에게는 날치기로 처리한 하자투성이의 절대보전지역지정해제처분 동의 의결을 즉각 취소할 것을 촉구한다. 작년 가을 문대림 도의회의장이 절대보전지역지정해제처분의 위법성을 강력하게 주장하였고 올해 여름 강정 해군기지 건설사업과 관련 공개질의에서 답변한 의원 21명 중 20명이 절대보전지역지정해제처분 동의안 처리의 부당성을 지적한 바 있다. 그럼에도 불구하고 제주도의회가 이를 바로 잡지 못한다면 이는 법을 만드는 입법기관이 불법을 용인하는 꼴이 되며 더 이상 도민의 신의를 받을 수 없을 것이다.’

‘도민의 혈세로 꾸려지는 제주도정과 제주도의회, 그리고 제주지방법원은 도민의 권익을 보호해야 하는 의무를 지닌 기관들이다. 이들이 법을 무시하고, 법 위에 군림하며, 도민의 권익을 유린하고 있는데도 이대로 방관만 한다면 제주사회의 미래는 암울할 따름이다. 하여 제주사회의 지식인들과 언론에게도 호소한다. 더 이상 침묵과 방관으로 일관하지 말고 용기와 소신을 갖고 바른 소리를 해주기를 바란다. 그래서 더 이상 제주사회가 불법과 탈법이 판을 치면서 힘없는 서민들만 계속 억울하게 고통을 당하는 그런 암울한 사회로 전락하지 않도록 노력해 주기를 호소한다.’

‘강정마을회는 법을 무시하고 일방적 추진을 강행하는 해군과 제주도정에 끝까지 항거할 것이며 해군기지반대투쟁을 통해 정의와 인권이 활짝 꽃 피는 그 날까지 가열찬 행군을 멈추지 않을 것이다.’

기자 회견을 마친 주민들은 2009년 도의회 당시 한나라당의 날치기 행태를 목격한 전 도의회 환경과 정책 개발 위원회 위원장이자 현 도의회 의장인 문대림 도의원과 만나 도의회가 부당한 절대 보전 지역 해제 취소에 대해 적극적으로 나설 것을 부탁했으나 문대림 의장은 제주 지법의 12월 15일이 나쁜 판결이자 정치적 판결이었다고 인정하면서도 도의회 조례상 일사 부재리의 원칙과 법원에 계류중인 항소 사건은 도의회에서 심의할 수 없다라는 원칙이 있다며 도의회가 쉽게 나설 수 없는 고충을 말했다 합니다.

정상적인 상식과 양심을 가진 사람이면 강정 마을이 해군 기지 예정지로 떨어진 2007년 4월부터 3년 7개월 여의 행정, 의회 과정이 얼마나 편의적, 탈법적으로 진행되어 왔는지 금방 알수 있읍니다. 이러한 밀어붙이기식 행정에 법원마저 면죄부를 주고 의회마저 그 구체적인 대안을 갖지 못하는 무책임한 처사에 강정 주민분들은 속에서 분노의 울음이 터져 나온다 합니다.

저는 콘크리트로 뒤덮일 중덕 바위 해안에서 최소한 한번씩은 통곡을 하고 왔다는 여러 주민분들의 말을 들은 바 있습니다. “힘없는 농민만 불쌍해,” 라는 그 분들의 자탄은 물신 위주 계급 사회로 치달려 가는 우리의 현실을 명징하게 보입니다.

어제 우근민 도정은 의회 예산 특별 위원회에서 최근 전액 삭감하였던 해군 기지 관련 예산 (강정 그린홈 보급 사업등 58~61억원)원안대로 다시 도의회에 제출하는 만용을 했읍니다. 12월 23일 제주 노동자들의 절규를 듣지 못했던 도정은 오늘 강정 주민들의 기자 회견문에 생생이 드러난 그 절규를 듣지 못하고 있으니 이 무슨 기막힌 정치입니까?

오직 양심과 정상적인 사회의 희망을 갖는 우리 민중들 만이 이 억압적인 사회 시스템을 변화시킬 수 있을 것입니다. 해군은 현재 해군 기지 가설 울타리안에서 숨어서 공사의 기초들을 다지고 있습니다. 27일 오전에 100 대 이상의 공사 트럭이 온다 합니다. 1 시간이라도 하루라도 싸움에 동참해주시길 다시 한번 부탁드립니다.

지치고 지쳤으나 후손들에게 있는 그대로의 고향을 물려주길 원하는 강정 주민분들을 이 크리스마스에 또한 헤아려 주시길.

0.1 %의 희망만 있어도 우리는 승리할 수 있다고 늘 생각해왔습니다. 기륭 노동자들은 6년의 투쟁 끝에 그것을 몸으로 보여준 바 있읍니다. 미국 평화 운동가 브루스 개그논은 미국 진보 언론인 크리스 헷지의 말을 인용한 바 있습니다: ‘희망은 두 딸을 갖고 있다. 하나는 정의로운 분노이고 또 다른 하나는 용기이다.’

얼마전에 아프가니스탄과 이라크 전쟁 예산에 반대, 138명의 활동가가 미국 수도 워싱턴에서 비폭력 저항으로 체포된 바 있습니다. 그들이 생각한 것은 바로 멀리 떨어져 있으나 생각만 해도 마음이 아픈 이라크와 아프가니스탄의 어린이들이었습니다.

이 크리스마스에 우리의 마음이 오늘 25일 3시에 중덕 바닷가에서 평화 미사를 올리실 강우일 주교님의 24일 메시지에도 있듯 가장 낮고 먼 곳으로 가자고 제 자신 다시 반성해 봅니다. 우리 후손들에게, 중국의 어린이들과 대적하라고, 세계 유일하게 3대 환경 보전 지역으로 지정된 평화의 섬 제주도에 미사일 방어망 시스템과 핵잠수함등의 온갖 열화 우라늄, 방사능 등이 오염된 곳에서, 미국의 동북아 침략 기지가 완성된 곳에서 살라고 할 수는 없는 일입니다.

끝으로 강정 주민 민성 아빠의 시를 소개하며 오늘은 이만 줄입니다.

바위는 엉엉 울었다.

동이 틀 무렵 중덕 바다를 찾았다.

범섬넘어 지평선엔 아직도 고기잡이 배 몇척이 불을 밝히고 있었다.

동이 트기 시작하자 고깃배 불빛은 서서히 육안에서 사라져갔다.

바다는 물 안개를 피워 올렸다.

태양은 서서히 아주 서서히 넓디 넓은 중덕의 바위를 비추어 갔다.

바위도 기지개를 펴며 태양을 맞이 하려 하였다.

나도 눈을 뜨고 천지를 보았다.

곳곳에 세워진 노란 깃발을 보았다.

용솟음 치는 민초의 몸부림을 그러나 찢기고 헤어져 글귀조차 읽을수 없었다.

바위는 갈망하다 절망하는 강정주민들에 절규를 아는지 바위는 몸부림 치며 울고있었다.

바위는 몸부림치며 울고 있었다.

강정바닷가 길게 늘어진 한 뭉탱이의 바위와 바다는 부둥켜 안고 소리내어 울고 있었다.

바람도 소리내어 울었으며 그곳에 살아 숨쉬는 모든 생명체도 통곡하며 엉엉 울었다.

그리고 나또한 소리내며 엉엉 울었다.

바위는 소의 울음소리보다 더 크게 울었다.

수억년이 흘러 용암석으로 변한 자신의 존재를 생각하면서 서러워서 바위는 엉엉 울었다.

우리 강정마을 주민들은 지난 3년 반 동안 생명과 평화의 땅, 강정마을을 지키기 위해 피눈물 흘리며 싸워왔다. 하지만 우근민 도정과 제주도의회, 그리고 제주지방법원은 우리의 진심을 끝내 외면하고 말았다.

우근민 도정은 입지선정의 정당성이 없음에도 불구하고 지난번 강정마을의 제안서를 통해 일정부분 정당성이 확보되었다고 강변하면서 해군기지사업을 추진하려 하고 있다. 우근민 도정은 제주도민 대화합을 전제로 하여 강정마을의 갈등이 해결이 되지 않는 한 해군기지사업을 추진하지 않겠다던 출범 당시의 태도를 버리고 오히려 강정마을의 갈등을 조장하고 있다. 그리고 천안함 사건과 연평도 사건으로 정부와 해군에서조차도 추진하기가 부담스러운 해군기지사업을 오히려 제주도정이 앞장서서 이끌려고 하고 있다.

우근민 도정은 해군기지사업을 위해 김태환 전도지사가 일방적으로 저지른 절대보전지역지정해제처분에 대하여는 이미 엎질러진 물이라고 하며 직권취소를 회피하고 있고, 토지수용이 끝나기도 전에 해당지역의 농로를 주민 동의도 구하지 않고 해군에게 매각처분한 것에 대해서도 침묵하고 있다.

지난 11월 29일 우근민 도지사는 정부의 확실한 보장책도 없고 국회에서 아직 통과도 되지 않은 제주특별자치도법 개정안을 내세워 말뿐인 강정지역발전계획을 제시하며 해군기지 수용을 촉구하는 설명회를 개최하였다. 그러나 대다수의 강정주민들은 진심이 결여된 그러한 제안에 동조하지 않았음을 밝힌다.

지난 22일 마을총회 투표결과 앞도적인 다수로 해군기지를 결사반대하는 것으로 결정되었다. 대화로 문제를 해결하려던 강정마을 주민들에게 결사반대의 길 외엔 다른 선택이 없게 만든 정부와 제주도정, 도의회 그리고 해군은 책임을 통감해야 할 것이다.

강정주민들은 설촌 이후 사백여년 동안 강정 바닷가에서 나는 해산물을 식량과 반찬으로 먹으면서 살아왔고, 이런 천혜의 환경을 보호하기 위해 도내에서 가장 먼저 고운환경감시단을 조직하여 지상과 수상 수중환경을 보전하는데 최선을 다한 결과 제주도에서도 가장 깨끗하고 서식 동식물군이 가장 다양한 해역을 지켜낼 수 있었다. 하여 강정마을은 2006년에 환경부지정 자연생태우수마을로 지정된 바 있다.

이제 절대보전지역지정해제처분의 법적인 문제점에 대해 언급하고자 한다. 제주특별자치도법은 절대보전지역의 지정 및 변경에 관하여 일반적이고 추상적인 기준만 규정하고 그 구체적인 기준을 도조례에 위임하고 있다. 이에 따라 제정된 도조례는 지하수자원ㆍ생태계ㆍ경관보전지구 1등급지역을 절대보전지역으로 지정하도록 규정하고 있다.

강정마을 해안 지역은 경관미가 매우 높다는 이유로 절대보전지역으로 지정받은 경관보전지구 1등급지역이다. 따라서 그 지역에 대하여 절대보전지역 지정을 해제하고자 한다면 현장조사를 해서 환경여건이 변화되어 이제는 1등급지역이 아니라는 판정을 한 다음 이를 해제해야 한다. 그러나 현장조사보고서에 의하면 “절대보전지역 지정 당시와 환경여건이 변화되지 않았다”고 기재되어 있다. 또한 멸종위기 야생동물인 붉은발 말똥게가 그 지역에 서식하는 사실이 발견되어 생태계보전지구 1등급지역에도 해당되게 되었다. 특별법과 도조례에 의하면 절대보전지역 지정을 해제할 수 없는 곳이다. 그럼에도 김태환 전 제주도정은 국책사업이라는 이유로 절대보전지역 지정 해제처분을 하여 특별법과 도조례를 정면으로 위반하였다.

사정이 그러함에도 제주도의회에서는 날치기까지 감행하면서 이에 동의하는 의결을 하여 공범자가 되었다.

이에 강정주민들은 절대보전지역 지정 해제처분이 내용적ㆍ절차적으로 중대한 하자가 있다고 보아 제주지방법원에 절대보전지역지정해제처분의 무효 내지 취소를 구하는 행정소송을 제기하였다.

하지만 제주지방법원은 그 위법성 여부에 대하여는 판단을 하지 않은 채 강정주민들이 원고적격이 없다는 이유로 소송을 각하하였다. 이는 헌법이 법원에게 부여한 사명을 망각한 판결이라 아니할 수 없다. 헌법은 법원에게 권력의 부당한 행사를 통제하고 국민의 기본권을 수호할 것을 명하고 있다. 권력 통제와 기본권 수호는 헌법이 법원에게 부여한 신성한 사명인 것이다. 그럼에도 제주지방법원은 헌법적 사명을 망각하여 위법성 여부에 대한 판단을 회피하는 판결을 함으로써 결과적으로 불법적인 공권력 행사에 면죄부를 주는 과오를 범했다.
강정주민들은 해군기지사업 예정부지에 거주하는 직접적인 이해당사자이다. 그런데도 제주지방법원에서 강정주민들에게 원고적격이 없다는 판결을 내린 것은 강정주민이 대한민국 국민이 아닌 불법체류자의 신분이라는 판결을 내린 것이나 다름없다. 만약 강정주민들이 소송조차 제기할 자격조차 없다면, 과연 그 누가 이런 불법적인 공권력 행사에 대해 문제를 제기할 수 있단 말인가.

제주지방법원의 판단대로 해당 지역주민도 소송을 제기할 수 없다면 도지사는 법적인 통제를 받지 않고 제 마음대로 제주도 전 지역의 절대보전지역 지정을 해제할 수 있다는 논리가 된다. 이는 도지사가 법 위에 군림하는 꼴을 용인하는 것이며 법치주의의 붕괴를 의미한다. 따라서 제주지방법원에게 항소심에서는 법치주의 확립 차원에서라도 법원의 헌법적 사명에 충실하고 법과 양심에 따라 공정한 판결을 해줄 것을 간곡하게 호소한다.

또한 제주도의회에게는 날치기로 처리한 하자투성이의 절대보전지역지정해제처분 동의 의결을 즉각 취소할 것을 촉구한다. 작년 가을 문대림 도의회의장이 절대보전지역지정해제처분의 위법성을 강력하게 주장하였고 올해 여름 강정 해군기지 건설사업과 관련 공개질의에서 답변한 의원 21명 중 20명이 절대보전지역지정해제처분 동의안 처리의 부당성을 지적한 바 있다. 그럼에도 불구하고 제주도의회가 이를 바로 잡지 못한다면 이는 법을 만드는 입법기관이 불법을 용인하는 꼴이 되며 더 이상 도민의 신의를 받을 수 없을 것이다.

한편 제주도의회 해군기지건설갈등해소특별위원회에서는 해군기지 건설 과정에서 발생한 갈등의 후유증을 해소하고 이를 교훈으로 삼아 제주사회의 공동체를 회복하여 미래 제주발전의 원동력으로 삼을 것이라고 공언한 바 있다. 하지만 과연 제주도의회 의원들이 강정마을 해군기지문제를 해결하기 위해 얼마나 노력했는지를 묻지 않을 수 없다.

도민의 혈세로 꾸려지는 제주도정과 제주도의회, 그리고 제주지방법원은 도민의 권익을 보호해야 하는 의무를 지닌 기관들이다. 이들이 법을 무시하고, 법 위에 군림하며, 도민의 권익을 유린하고 있는데도 이대로 방관만 한다면 제주사회의 미래는 암울할 따름이다. 하여 제주사회의 지식인들과 언론에게도 호소한다. 더 이상 침묵과 방관으로 일관하지 말고 용기와 소신을 갖고 바른 소리를 해주기를 바란다. 그래서 더 이상 제주사회가 불법과 탈법이 판을 치면서 힘없는 서민들만 계속 억울하게 고통을 당하는 그런 암울한 사회로 전락하지 않도록 노력해 주기를 호소한다.

강정마을회는 법을 무시하고 일방적 추진을 강행하는 해군과 제주도정에 끝까지 항거할 것이며 해군기지반대투쟁을 통해 정의와 인권이 활짝 꽃 피는 그 날까지 가열찬 행군을 멈추지 않을 것이다.

Yesterday, there were the members of the Jeju 4. 3 Research Institute, an artist and a poet who have slept in the tent last night, committed to the Pan-Island Committee’s relay tent vigil in the early morning of Dec. 23. All were women and those women’s strong sit-in relay was followed by other nine women members of the Jeju Island branch, Korean Women Peasant Association (KWPA).

Among the members of KWPA, there was Han Kyung-Rye, Chairperson of KWPA’s Jeju Island branch (launched in 1997/ founded by its first chairperson, Hyun Ae-Ja, a former National Assembly woman) who talked about the crisis of rice farming after the WTO stipulation on the obligation of each country’s rice import by 7% in 2005 ; matters worse, the sudden drop of rice price (retrograded to its price, 20 years ago) due to Lee Myung-Bak government’s corporation-friendly agriculture policy and its hostile policy against North Korea; the reality of the 50% income drop for each rice-farming household; and the reality of the price drop of the alternative crops following the rice price decline. She also talked about the KWPA’s independent activities regarding those matters.

It is told that the self-support rate of food, South Korea is currently guessed less than 25% as most of SK’s agriculture areas have been opened to overseas since the WTO meeting in 1994. The KWAP (launched on Feb. 13, 1989) is making effort to make higher the legal rate of food self-support up to 40%. The food-sovereignty is the ‘right that a nation’s people can decide on the matter of their food.’ It was told that the KWAP has been carrying the movements such as those for distribution of native seeds and for cultivation of kitchen garden (including the ‘Kkurumi business’ which promotes the relationship between producer and consumer by sale and purchase of the organic crops especially from native seeds. Currently the business reached to about 50 consumers. Such independent movements by the KWAP are to contribute to protect the right of women peasants such as on the matter of economy, as well as the right of consumers for safe food.

The KWPA and Korean Farmers’ League importantly consider self-reliance, democracy and unification movement of a nation because only by unification, the alternative of current problematic agriculture could be solved. (For reference, the regions of North Korea have been less fitting to agriculture than those of South Korea, in nature environment). Chairperson Han was so sorry that the tangerines of the Jeju Island have not been able to reach to North Korea since the launch of the Lee Myung-Bak government, as the reconciliation exchange policies by the former Kim Dae-Jung and Lee Myung-Bak governments have been cut-off. When the peaceful exchange policy and its practice were in their highest, North Korea has even invited about 200 Jeju Island people, for her expression of thank to them. Now most of them have been cut off under the Lee government.

As the weather has become colder again, the seven strong women peasant countered winds singing ‘The Farmers song’ and ‘Like a Rock.’ It looked very good whenever the members of KWAP said hello to every Olle tourist passing by the sit-in site.

Otherwise, there was the rally protesting against the oppression of the workers held by the Jeju Island branch of the Korean Confederation of Trade Unions, at 7pm, last evening. It included five workers’ hair-shaving off to express workers’ will to fight against the Woo Geun-Min Island government who had ignored the Jeju workers’ demands for the right to live. Five workers- of whom three, including Mr. Go Dae-Un, Chairman of the Jeju Island branch of the KCTU, have been in the Pan-Island Committee’s tent sit-ins against the planned Jeju naval base, in Gangjeong village last Dec. 21- expressed their firm will by haircutting. Also to be glad there was to see Hyun Ae-Ja, the recently elected Chairwoman of the Jeju Island branch of the Democratic Labor Party and the former National Assembly member. Hyun said the most important issues in the Jeju Island, currently, are those of the struggle against the naval base construction and of labor movement.

As many cases of labor oppressions such as in the Dongseo Transportation co., Jeju Clinic, Island Provincial Artists’ union, Woosung APT., Yeominji Botanical Garden, in the Jeju Island, many workers have been in the tent sit-ins in front of the Island Hall for more than a month since Nov. 23, countering cold wind and discomfort. Their tent-sit in met its 31st as of yesterday. And “it took 30 days” for the workers to be finally allowed by the Island government officers to have a meeting table with them. And when those in the Woo Geun-Min Island government that has been attempting to enforce naval base in the Gangjeong village said that the workers could have right to negotiate with them only after the workers withdraw their tent, the infuriated workers have broken the glass in the front gate of the Island Hall. Their rally including shaving their hairs happened right after that event.

The Woo Geun-Min Island government, Lee Myung-Bak government and the United States government who ignore people’s righteous demands for the rights including the right to live and leak people’s bloody tax into war base should be criticized.

People’s bloody tax for the welfare of all the people including workers, farmers, women, and disabled, not for military base!

Note: Tomorrow, on Dec. 24, the Gangjeong Village People’s Council plans to appeal to a higher court, regarding the Jeju local court’s judgment of improper qualification of the plaintiffs (the villagers) on Dec. 15; to announce the the result of the Gangjeong villagers’ general meeting on Dec. 22,; and to announce the Gangjeong villagers’ demand items to the Island government and Island Assembly. There will be also the Catholic’s solidarity missal for labor movement in front of the Island Hall at 7pm.

어제 12월 23일 이른 오전, 범대위의 천막 농성에 한 분들은 그저께 밤 천막에서 취침하신 제주 4. 3 연구회분들과 화가, 시인이셨읍니다. 모두 여성들로 여성들의 씩씩한 농성 릴레이는 오전과 오후, 제주도 여성 농민회 회원 9분들로 이어졌습니다.

여성 농민회 회원분들 중에는 한경례 제주 여성 농민회(1997년 출범, 초대 회장 현애자 전 국회 의원님) 회장님도 계셨는데 2005년 WTO 수입쌀 7% 의무화 이 후 쌀 농업이 처하게 된 위기, 설상 가상으로 이명박 정부의 기업 친화적 농업 정책과 대북 적대 정책으로 인한 쌀가격의 급락(20년전 가격으로 하락)과 쌀 농가 소득의 50% 하락 실상, 그에 따른 대체 작물의 가격 급락 현황 등 현재 농업이 처한 위기에 대해 말씀하셨읍니다. 또한 여성 농민회의 독자적 대응 활동에 대해서도 말씀해주셨습니다.

1994년 WTO 이후 우리 나라의 거의 모든 농업이 개방되어 현재 우리 나라의 식량 자급률은 현재 25% 도 안될 거라 합니다. 여성 농민회(1989년 2월 13일 출범)와 농민회는 자급율을 40%로 올리는 것을 법제화하는 노력을 하고 있습니다. 이 식량 주권은 ‘식량의 문제를 그 나라 국민이 결정할 수 있는 권리’인데 전국 여성 농민회는 2009년 상설 위원회를 공식 출범, 토종묘 보급 사업단 운동 및 우리 텃밭 사업단 (생산자와 소비자 간 토종묘 중심 유기농 텃밭 농작물 판매 및 구매인 꾸러미 사업 포함)을 펼쳐오고 있었다 합니다. 현재 제주도에는 꾸러미 사업이 50 여 소비자와 관계를 맺고 있으며 여성 농민회의 이러한 독자적 운동은 여성 농민의 경제권을 포함한 권리 수호와 소비자의 안전 먹거리에 기여하는 운동입니다.

여성 농민회와 전국 농민회는 또한 조국의 자주화 민주화 통일 운동을 중요시 여기는데 통일이 되어야 농업의 대안도 같이 풀릴 수 있기 때문입니다(북한의 지역들보단 남한의 지역들이 농업에 더 맞게 자연 환경이 형성되어 있음). 한회장님은 이명박 정부들어 전 김대중, 노무현 정부의 남북 화해 교류 정책이 봉쇄되며 제주의 감귤 또한 북한에 못가게 된 것을 통탄해하고 계셨습니다. 평화 교류 정책과 그 실천이 활발했을 때 북한에서는 제주도민 200여명을 감사의 표현으로 초청하기 까지 했답니다. 이명박 정부 아래 대부분의 실천들이 차단되었지요.

오후 들어 날씨가 다시 쌀쌀해지자 깃발을 들고 씩씩하게 서신 7분의 여성 농민회 회원분들은 농민가, 바위처럼등을 부르며 바람에 맞섰읍니다. 여성 농민회 회원분들이 지나가는 올레 꾼들에게 일일이 인사하시는 모습이 참 좋아 보였습니다.

한편, 어제 저녁, 7시 제주시에서는 제주 민주 노총 노동자 분들의 우근민 도정의 노동자의 생존권 요구를 무시하는 것에 항의하는 삭발 투쟁 결의등 제주 지역 노동자 탄압에 항의하는 집회가 있었습니다. 해군 기지 반대 연대 투쟁으로 12월 21일 범대위 강정천 근처 천막 농성에도 오셨던 7분의 노동자 분들 중, 민주 노총 제주 지부장 고대언 선생님등 세분을 포함, 5분이 삭발로 결의를 다지셨습니다. 또한 최근에 민주 노동당 제주 도당 위원장으로 당선되신 현애자 전 국회 의원님도 자리에 계셔 든든하고 반가왔읍니다. 현애자 전 국회 의원님은 현재 제주에서 가장 중요한 것은 해군 기지 반대 이슈와 노동 운동이라 하셨읍니다.

현재 제주에는 동서 교통, 의료원, 도립 예술 노조, 우성 아파트, 여민지 식물원등 많은 곳에서 노동 탄압 사례가 불거지며 노동자들은 연대하여 도청 앞에서 추운 바람과 불편을 이기며 11월 23일부터 한달 간 천막 농성을 하고 계셨습니다. 어제는 그 한달째로 첨부된 기사 링크들에서 보시듯 도정 관리들과 대화 테이블을 가지는 것 조차 “30여일 걸렸습니다” 그러나 해군 기지를 강정에서 강행하려는 바로 그 우근민 도정이 천막을 집어쳐야 교섭할 수 있다 말하자 화가 난 노동자들은 도청의 현관 유리를 깨기도 했습니다. 삭발 및 항의 집회는 바로 그 직후에 이루어진 것이었습니다.

민중의 정당한 생존권 요구와 권리를 무시하고 한편에서 민중의 혈세를 전쟁 기지로 빼돌리려는 우근민 도정, 이명박 정부, 그리고 미국 정부는 비판받아야 옳습니다.

민중의 혈세를 군사 기지아닌 노동자, 농민, 여성, 장애인 포함 모든 민중의 복지비로 !

Yesterday, on Dec. 22, female members of the Jeju Consultation Office for the Victimized Women by Sex trade, Jeju Women Human Rights Solidarity, and Jeju. 4. 3 related organizations rotated the tent sit-ins in front of the planned naval base area. The warm weather became cold in the afternoon but we could well finish the day’s sit-ins by the sun-set thanks to the Olle tourists’ encouragement. Mr. Hong Ki-Ryong, Chairman of the Pan-Island Committee and some peace activists have gladly visited and stood with us with signs. An Olle tourist have taken photo with us saying he also opposes the naval base in the Jeju Island (Refer to the photos)

Otherwise, it was the time to think of the issues on women, thanks to the members of the women organizations even though it was for a short time. A woman member from the Consultation Office for the Victimized Women for the Sex Trade talked about the Mindlle Pilgrim activities that cherish the memories of the victimized women by sex trade. It is the event, commemorating the special law on the prevention of the sex trade, which has begun to be carried out since Sept. 23, 2004. There were five victims in the Jeju Island this year but the bereaved families of only two of them came-sadly reminding the lives of the easily forgotten women.

Ha Soon-Nam, a senior in the Jeju Women Human Rights, who has researched, collected and published a poetry book about the wild grasses in the Jeju Island, talked about the Moselpo air base that has been used by the Japanese imperial army then by the U.S. military until the latter withdrew in the early 90s. She told that the vicinity areas of the base was lit by the artificial lights that came from the military camp side towns nearby every night. It would be women who would be one of the most victimized if the naval base comes in the Jeju Island. The meaning of the women’s voice and resistance against the anti-women nationalism, militarism culture must be very big in the struggle against the naval base in the Jeju Island.

Otherwise, the villagers made their final decision on the naval base at the villagers’ general meeting held at 7pm on the day. It was the resumption of the Dec. 17 meeting that made no conclusion. While 106 villagers joined it, 87 votes for struggle to the end, 6 votes for conditional acceptance of the naval base, 12 votes for abstention and 1 vote for nullity. The ‘village’s response on the Dec. 15 Jeju local court decision of dismissal of the plaintiffs in the lawsuit on the confirmation on the cutoff and annulment of the cancellation disposal of the absolute preservation area’ was also discussed. Kang Dong Kyun, the mayor of the Gangjeong village said that he had made immediate complaint on Dec. 21 for the Dec. 15 court decision and would appeal the lawsuit to a higher court on coming Dec. 24.

Mayor Kang said, “While the issue of the naval base is important, I feel more painful to see that the villagers are becoming divided one another due to the naval base issue. The whole responsibility for that should be charged to the Jeju Island, navy and government, “ added that “ Even though we have expected that a breakthrough for talk would be made since the new Island government that has said it would find everyone’s win-win way launched, nothing has eventually changed."

He also said, “We would try to stage the opposition movement within the legal frame, restraint of extreme actions, as we have done peaceful and legal struggles by now. However, as there were lots of villagers’ opinions to strongly prevent the navy’s material entry planned on Dec. 27, we would discuss struggle method for the day afterward.”

Otherwise, there would be the Catholic’s peace mass against the naval base, lead by a bishop, Kang Woo-Il in the Joongduk coast. There will be also another Catholic peace mass in front of the Island Hall after the villagers’ application for appeal and press interview at 3pm, Dec. 24. Some people will visit the workers’ solidarity rally being held in front of the Island Hal, City of Jeju at 7pm, Dec. 23.

S Korea to stage ground, air firing drill Thursday

SEOUL: South Korea plans to hold a major drill Thursday involving artillery guns and fighter jets following its live-fire drill near a disputed sea border earlier this week, the Army said Wednesday.

The ground and air firing drill, which officials said is part of routine exercises, will take place at a firing range in Pocheon, 40 kilometers northeast of Seoul and 25 kilometers south of the heavily fortified land border between the two Koreas.

It follows a firing drill Monday from the western border island of Yeonpyeong shelled last month by the Democratic People's Republic of Korea (DPRK). The country also started Wednesday four- day sea maneuvers in waters off the east coast of the Korean peninsula.

The series of routine exercises come amid heightened tension in the region as South Korea remains on alert against retaliation from the DPRK, which did not immediately respond to Monday's brief shooting drill it had vehemently protested.

China calls for restraint, dialogue on Korean Peninsula issue

Russian, DPRK diplomats discuss situation on Korean peninsula

MOSCOW: Diplomats of Russia and the Democratic People's Republic of Korea (DPRK) met here Tuesday and discussed possible measures to stabilize the situation on Korean peninsula.

During the meeting with the DPRK ambassador to Moscow Kim Yong Jae, Russian Deputy Foreign Minister Alexei Borodavkin stressed that Russia is seeking "solutions to the issues between Pyongyang and Seoul by political-diplomatic ways," according to a statement of the Russian Foreign Ministry. Right on schedule the right-wing government, led by South Korean President Lee Myung-bak (nicknamed the bulldozer and the rat by his people), stepped up with another round of war games virtually on the North Korean border. These military exercises, coming regularly these days, are without a doubt being strongly encouraged by the Obama administration who themselves are taking on the role of playground bully when it comes to North Korea and Iran. Thank goodness North Korea was wise enough to show restraint as clearly the U.S. and their junior-partners in Seoul are not capable of doing so.'

Interview with Henry Em on Yeonpyeong Island

On November 22, 2010, military troops from the Republic of Korea (ROK, or South Korea) and the United States began joint war-simulation exercises involving approximately 70,000 soldiers, 600 tanks, 500 warplanes, 90 helicopters, and 50 warships. On November 23, South Korean artillery units fired artillery for four hours into contested waters claimed by both Pyongyang and Seoul near the Northern Limit Line (NLL). Drawn unilaterally by the US Navy in 1953, the NLL is neither internationally recognized nor accepted by the Democratic People's Republic of Korea (DPRK, or North Korea).

North Korean artillery units responded by firing on a South Korean artillery base on Yeonpyeong Island. The South Korean marines responded by firing back at North Korean bases on the coast across from the island. On Yeonpyeong Island, a site with South Korean military bases and a fishing community of 1,300 residents, North Korean artillery killed two South Korean marines and two civilian contractors building new barracks on a military installation. The attack left eighteen others injured. North Korea has not yet disclosed its casualties, but one South Korean report indicates that one North Korean soldier was killed and two others were seriously wounded.*

To make sense of why this dangerous and tragic situation occurred, the Korea Policy Institute interviewed Dr. Henry Em, Associate Professor in the Department of East Asian Studies at New York University (NYU). Dr. Em serves on the steering committee of the Alliance of Scholars Concerned about Korea (ASCK) and KPI's advisory board. His teaching and research interests include Korean historiography, nationalism, colonialism, and imperialism in twentieth-century Korea, transnational and cultural studies of the Korean War, and the Korean diaspora. Among other honors, Dr. Em was the recipient of a Fulbright Scholar Program Fellowship, as well as grants from the Freeman Foundation and the National Endowment for the Humanities. His book Sovereignty and Modern Korean Historiography will be published by Duke University Press. His chapter on modern Korean historiography, forthcoming, will appear in volume 5 of the Oxford History of Historical Writing from Oxford University Press.

Like the Korean churches, Ahn compares the havoc resulting from the reckless brinksmanship played by world leaders to the violent trauma of the Korean War. Who's paying the price: innocent and ordinary civilians of both countries, especially elder survivors of the war that has never ended:
On Monday, the Korean peninsula averted a cataclysmic showdown that could have escalated into full-blown war. The United Nations Security Council wasn’t able to conclude a statement that would defuse tensions, with countries lining up along Cold War divisions.

Seconds before I appeared on Al-Jazeera International Sunday night, the producer informed me that South Korea, despite pleas from both Russia and China to cancel the live fire artillery drills, had in fact started the exercises. Having been to North Korea several times, and knowing how their worldview centers on the right to defend their sovereignty, I feared the worst.

But by the time I returned home, the South Korean military drills were over. It lasted 94 minutes. North Korea, which had promised to retaliate with even more force than the November 23 shelling of Yeonpyeong island, decided that the South’s aggression was “not worth reacting” to. According to the North’s Korean Central News Agency, “The world should properly know who is the true champion of peace and who is the real provocateur of a war.”
